§ 2-76. Liability.

  • Any county officer or employee who is charged with the enforcement of any of the provisions of this Code or other county ordinance, while acting lawfully, in good faith and without malice in the discharge of official duty, shall not thereby render himself liable personally, and he is hereby relieved from all personal liability, for any damage that may accrue to persons or property as a result of any act or omission required or permitted in the discharge of his official duties. Any suit instituted against any county officer or employee because of an act performed by him in the lawful discharge of his duties and under the provisions of this Code or other ordinance shall be defended by the county attorney until the final termination of the proceedings. In no case shall any such officer or employee be liable for costs in any action, suit or proceeding that may be instituted in pursuance of the provisions of this Code or other ordinance.
